ABSTRACT:Should companies’ human rights responsibilities arise, in part, from their “leverage”—their ability to influence others’ actions through their relationships? Special Representative John Ruggie rejected this proposition in the United Nations Framework for business and human rights. I argue that leverage is a source of responsibility where there is a morally significant connection between the company and a rights-holder or rights-violator, the company is able to make a contribution to ameliorating the situation, it can do so at modest cost, and the (...) threat to human rights is substantial. In such circumstances companies have a responsibility to exercise leverage even though they did nothing to contribute to the situation. Such responsibility is qualified, not categorical; graduated, not binary; context-specific; practicable; consistent with the social role of business; and not merely a negative responsibility to avoid harm but a positive responsibility to do good. In the late Middle Ages the philosopher and mystic Meister Eckhart preached that to know the truth you must be the truth. But how to be the truth? Eckhart's answer comes in the form of an imperative: release yourself, let be. Only then will you be able to understand that the deepest meaning of being is releasement. Only then will you become who you truly are. This book interprets Eckhart's Latin and Middle High German writings under the banner of an (...) imperative of releasement, and then shows how the twentieth-century thinker Martin Heidegger creatively appropriates this idea at several stages of his career. Heidegger had a lifelong fascination with Eckhart, referring to him as "the old master of letters and life." Drawing on archival material and Heidegger's marginalia in his personal copies of Eckhart's writings, Moore argues that Eckhart was one of the most important figures in Heidegger's philosophy. This book also contains previously unpublished documents by Heidegger on Eckhart, as well as the first English translation of Nishitani Keiji's essay "Nietzsche's Zarathustra and Meister Eckhart," which he initially gave as a presentation in one of Heidegger's classes in 1938. BackgroundSocio-cultural perceptions surrounding death have profoundly changed since the 1950s with development of modern intensive care and progress in solid organ transplantation. Despite broad support for organ transplantation, many fundamental concepts and practices including brain death, organ donation after circulatory death, and some antemortem interventions to prepare for transplantation continue to be challenged. Attitudes toward the ethical issues surrounding death and organ donation may influence support for and participation in organ donation but differences between and among diverse populations have not (...) been studied.ObjectivesIn order to clarify attitudes toward brain death, organ donation after circulatory death and antemortem interventions in the context of organ donation, we conducted a scoping review of international English-language quantitative surveys in various populations.Study appraisalA search of literature up to October 2020 was performed, using multiple databases. After screening, 45 studies were found to meet pre-specified inclusion criteria.Results32 studies examined attitudes to brain death, predominantly in healthcare professionals. In most, around 75% of respondents accepted brain death as equivalent to death of the person. Less common perspectives included equating death with irreversible coma and willingness to undertake organ donation even if it caused death. 14 studies examined attitudes to organ donation following circulatory death. Around half of respondents in most studies accepted that death could be confidently diagnosed after only 5 min of cardiorespiratory arrest. The predominant reason was lack of confidence in doctors or diagnostic procedures. Only 6 studies examined attitudes towards antemortem interventions in prospective organ donors. Most respondents supported minimally invasive procedures and only where specific consent was obtained.ConclusionsOur review suggests a considerable proportion of people, including healthcare professionals, have doubts about the medical and ethical validity of modern determinations of death. The prognosis of brain injury was a more common concern in the context of organ donation decision-making than certainty of death. (shrink)

In the part of the first Critique known as “The Paralogisms of Pure Reason” Kant seeks to explain how even the most acute metaphysicians could have arrived, through speculation, at the ruefully dogmatic conclusion that the self (understood as the subject of thoughts or "thinking I") is a substance. His diagnosis has two components: first, the positing of the phenomenon of “Transcendental Illusion”—an illusion, modelled on but distinct from, optical illusion--that predisposes human beings to accept as sound--and as known to (...) sound--certain in fact flawed arguments for substantive theses about the nature of the self; second, the identification of the fallacy we commit when we succumb to this illusion. It is explained how these two elements combine to produce a central instance of (what Kant sees as) dogmatic speculative metaphysics, namely, the doctrine that the self is a substance in the sense of a necessarily non-inhering subject of inherence. It is argued that Kant has a novel, ingenious, and even somewhat plausible account of the route by which the rational psychologist arrives--or might arrive--at this view, an account that involves identifying a rather deep-rooted confusion about the very nature of conceivability. The paper argues that philosophers commonly misidentify the substitutivity principle involved in Russell’s puzzle about substitutivity in “On Denoting”. This matters because when that principle is properly identified the puzzle becomes considerably sharper and more interesting than it is often taken to be. This article describes both the puzzle itself and Russell's solution to it, which involves resources beyond the theory of descriptions. It then explores the epistemological and metaphysical consequences of that solution. One such consequence, it argues, is that (...) Russell must abandon his commitment to propositions. (shrink)

Duration distortions familiar from trauma present an apparent counterexample to what we might call the naive view of duration perception. I argue that such distortions constitute a counterexample to naiveté only on the assumption that we perceive duration absolutely. This assumption can seem mandatory if we think of the alternative, relative view as limiting our awareness to the relative durations of perceptually presented events. However, once we recognize the constant presence of a stream of non-perceptual conscious mental activity, we can (...) provide an attractive, purely relative account of temporal distortions quite consistent with the naive view. I also consider (and reject) a second empirical challenge to the naive view arising from the so-called ‘oddball effect’. I conclude by tentatively pointing to further empirical data, traditionally accounted for in terms of an internal clock model of timing, which, I suggest, may be understood more illuminatingly by appeal to the idea that we perceive duration in part relative to concurrent non-perceptual mental activity. The question of why Ukraine became Christianized from Byzantium and what kind of faith she accepted - in general, Christian, Orthodox, or Catholic - is not new. We have the views that stand for any of these three assumptions. They are formed depending on the data of religious beliefs, political orientations, etc.

L.L. Maksimova and L. Esakia, V. Meskhi showed that the modal logic \ has exactly 5 pretabular extensions PM1–PM5. In this paper, we study the problem of unification for all given logics. We showed that PM2 and PM3 have finitary, and PM1, PM4, PM5 have unitary types of unification. Complete sets of unifiers in logics are described.

The aim of Dimitris Vardoulakis’s paper, ‘Toward a Critique of the Ineffectual: Heidegger’s Reading of Aristotle and the Construction of an Action without Ends’, is to provide the foundation for a critique of aimless action by tracing its genesis to Heidegger’s putative misinterpretation of Aristotelian phronēsis (practical wisdom) in the 1920s. Inasmuch as ‘the ineffectual’—the name Vardoulakis gives to action devoid of ends—plays a crucial role in post-Heideggerian continental philosophy, he thereby seeks to diagnose and to provide an aetiology of (...) an illness afflicting contemporary thought. In my response, I will first argue that, while Vardoulakis is right to identify an emphasis on the ineffectual in Heidegger, he is mistaken about its origin. Heidegger does not strip phronēsis of instrumentality, nor does he mistranslate Nichomachean Ethics 1139a31–32. Second, I trace an alternative source for the ineffectual, which is not simply a negative alternative to technological machination but stems from a positive experience of what Meister Eckhart, and Heidegger in his wake, called life without why. Finally, I look at a couple of texts, including one discussed by Vardoulakis, in which even the later Heidegger is not entirely dismissive of calculative instrumentality but instead assigns the latter to a secondary, restricted site of competence. If so, are they irreducible, or can modal facts be explained in other terms? This volume presents new work on modality by established leaders in the field and by up-and-coming philosophers. A dealbreaker, in the sense developed in this essay, is a relationship between a person's psychology and an aspect of an artwork to which they are exposed. When a person has a dealbreaking aversion to an aspect of a work, they are blocked from embracing the work's aesthetically positive features. I characterize dealbreakers, distinguish this response from other negative responses to an artwork, and argue that the presence or absence of a dealbreaker is in some cases an appropriate target of (...) moral evaluation. I then use the concept of dealbreakers to develop a new approach to the question of our moral obligations with respect to the work of immoral artists, arguing that there is no general obligation binding us to cultivate or eliminate a dealbreaking aversion to their work. I conclude by suggesting several other philosophical debates that could benefit from a focus on dealbreakers. (shrink)

In the Tractatus Wittgenstein criticizes Frege and Russell's view that laws of inference (Schlussgesetze) "justify" logical inferences. What lies behind this criticism, I argue, is an attack on Frege and Russell's conceptions of logical entailment. In passing, I examine Russell's dispute with Bradley on the question whether all relations are "internal".

I argue that misanthropy is systematic condemnation of the moral character of humankind as it has come to be. Such condemnation can be expressed affectively and practically in a range of different ways, and the bulk of the paper sketches the four main misanthropic stances evident across the history of philosophy. Two of these, the Enemy and Fugitive stances, were named by Kant, and I call the others the Activist and Quietist. Without exhausting the range of ways of being a (...) philosophical misanthrope, these four suffice to justify my main claim that misanthropy should not be seen specifically in terms of hatred and violence. We should attend to the varieties of philosophical misanthropy, especially since doing so reveals a deeper phenomenon I call the misanthropic predicament. (shrink)

Throughout the writings of Paul Feyerabend, there are constant references to the historical contingency of the scientific enterprise, often accompanied by philosophical claims about the significance of that contingency. This paper presents those contingentist claims, situates them in the context of more recent work on the contingency of science, and offers an interpretation of their significance. I suggest that Feyerabend’s sense of contingency was connected to his defences of pluralism, and also to the ‘conquest of abundance’ narrative developed in the (...) very late writings. (shrink)

This chapter describes some of the varieties of philosophical humanism and different conceptions of, and attitudes towards, the natural sciences. I focus on three kinds of humanism evident in 20th century European philosophy – humanism as essentialism, humanism as rational subjectivity, and existential humanism. Some are strongly allied to the sciences, others are antipathetic to them, while others offer subtler positions. By emphasising this diversity, I want to oppose claims about the inevitability of an 'alliance' of science to humanism, and (...) that claim that to be a humanist is something we must approve or applaud. At best, those 'alliances' and that praiseworthiness will only be true of certain varieties of humanism. (shrink)
